Gamecheck Chrome Extension Terms of Use, Subscription Terms and Privacy Notice

These Terms of Use, Subscription Terms and Privacy Notice apply to the Gamecheck Chrome browser extension, the Gamecheck player account, the Gamecheck website, Gamecheck reports, Gamecheck status messages, Gamecheck investigation tools and any related services made available by Gamecheck Limited.

Please read this document carefully before creating an account, installing the extension, submitting a screenshot, allowing the extension to capture a game launch URL, purchasing a subscription or relying on any Gamecheck status message.

By creating an account, installing the extension, purchasing a subscription or using Gamecheck, you agree to these Terms.

1. Who we are

In these Terms, "Gamecheck", "we", "us" or "our" means Gamecheck Limited.

2. What Gamecheck does

Gamecheck provides a Chrome browser extension that allows players to submit information about an online casino game so that Gamecheck can help assess whether the game is Real, Fake, unable to be verified, outside Gamecheck's contracted provider coverage, or requires further assessment.

Gamecheck's service is designed for players. It is not designed for casino operators, affiliates, suppliers, regulators, law firms, investigators or game providers unless Gamecheck separately agrees otherwise in writing.

Gamecheck works by collecting limited information from a player-initiated game session, including a screenshot of the casino game frame and the game launch URL or related launch information. Gamecheck uses this information to identify the game, identify the relevant game provider, compare the launch information against provider whitelists or provider-confirmed data, and where necessary send evidence to the relevant game provider for assessment.

Gamecheck does not operate casino games, provide gambling services, accept bets, process wagers, hold player funds, determine casino licensing status, provide gambling advice, provide financial advice, provide legal advice or act as a regulator.

Gamecheck is an authenticity-checking and information service only.

3. Important limits of the service

Gamecheck status messages and reports are informational only.

Gamecheck does not guarantee that every submission will receive a final result. Whether a result can be returned may depend on:

  1. whether the relevant game provider is contracted with Gamecheck;
  2. whether the game provider has provided approved whitelist data;
  3. whether the provider responds to Gamecheck;
  4. whether the provider confirms the evidence as real or fake;
  5. whether the casino allows the required launch URL data to be collected;
  6. whether the screenshot is genuine, clear and accurate;
  7. whether the submitted information matches the game actually played; and
  8. whether Gamecheck has enough technical evidence to perform the check.

Gamecheck does not make an independent legal finding of fraud, dishonesty, criminality, regulatory breach or wrongdoing by any casino, supplier or provider.

Gamecheck's conclusions are based on provider responses, provider whitelists, provider-confirmed information, technical information collected through the extension, and evidence available to Gamecheck at the time.

Where Gamecheck uses the status "Fake", this means Gamecheck has received clear provider-confirmed evidence, provider-supplied information, or provider-approved whitelist evidence indicating that the game session is not genuine, is not authenticated, or does not correspond to the provider's genuine authorised game environment.

Where Gamecheck uses the status "Real", this means the game appears to match provider-confirmed information, provider-approved whitelist data, or a provider response confirming that the game session is authentic.

4. Eligibility and age restriction

You must be at least 18 years old to use Gamecheck.

By creating an account, installing the extension or using the service, you confirm that:

  1. you are at least 18 years old;
  2. you are using Gamecheck for personal, lawful, non-commercial player purposes;
  3. you are legally permitted to access online casino games in your location;
  4. your use of Gamecheck does not breach any law, regulation, court order, casino rule or contractual obligation that applies to you;
  5. all information you submit to Gamecheck is accurate, genuine and not misleading; and
  6. you will not use Gamecheck to harass, threaten, defame, blackmail or unlawfully pressure any casino, supplier, provider or person.

Gamecheck does not currently verify your age directly. You are responsible for ensuring that you are legally permitted to use the service.

5. Gibraltar gambling-law position

Gamecheck is not a gambling operator.

Gamecheck does not:

  1. offer gambling;
  2. accept, negotiate or facilitate bets;
  3. operate casino games;
  4. act as a bookmaker;
  5. hold player funds;
  6. pay winnings;
  7. provide casino wallets;
  8. provide gambling software to casinos;
  9. control game outcomes;
  10. certify gambling compliance for regulatory purposes; or
  11. act as a gambling regulator.

Gamecheck is a technical verification and information tool for players. If Gamecheck's business model, functionality or commercial relationships change in a way that brings Gamecheck within the scope of Gibraltar gambling licensing requirements, Gamecheck will review its regulatory position before offering that functionality.

The current Gibraltar gambling legislation includes the Gambling Act 2025. The Terms frame Gamecheck carefully as a verification and information service rather than a remote gambling operator.

6. Account registration

To use Gamecheck, you may be required to create an account.

During registration and account use, Gamecheck may collect:

  1. username;
  2. email address;
  3. IP address;
  4. browser version;
  5. time zone;
  6. timestamps;
  7. account session identifiers;
  8. subscription status;
  9. payment status;
  10. account usage records; and
  11. security and access logs.

Gamecheck does not require your full name, phone number or device ID during standard registration.

You are responsible for keeping your login details secure. You must not share, sell, transfer, rent, resell or allow another person to use your Gamecheck account.

7. Device and session limits

Each Gamecheck account may be used on a maximum of two devices.

Each Gamecheck account may have a maximum of two simultaneous sessions.

Gamecheck may suspend or terminate an account where Gamecheck detects access patterns inconsistent with normal individual use, including repeated access from multiple devices in different countries, suspected account sharing, suspected resale, automation, bot usage or misuse of the extension.

8. Free trial

Gamecheck may offer a free trial allowing a user to check up to three games before subscribing to a paid plan.

The free trial is subject to these Terms. Gamecheck may withdraw, limit or change the free trial at any time, including where Gamecheck suspects abuse, account duplication, automation, fraudulent screenshots or misleading submissions.

9. Paid subscriptions

Gamecheck may offer paid subscription access through Lite, Plus and Pro plans.

The subscription plan, included features, number of checks, billing period, taxes, renewal terms and available payment methods will be shown at checkout before the user purchases.

Where a subscription is described as recurring, it renews automatically unless cancelled before the renewal date.

Gamecheck may also offer annual subscriptions. Where stated at checkout, annual subscriptions may receive a 10% discount compared with monthly pricing or another discount shown at checkout.

9.1 Regional pricing model

Gamecheck uses affordability bands rather than direct currency conversion. A GBP 6.99 Plus price converted directly into every currency would be unfair in lower-income markets and would reduce adoption.

Regional pricing is based on affordability, local payment behaviour, taxes, fraud risk and market maturity. Gamecheck may adjust pricing bands, local rounding, taxes, plan availability and promotional pricing from time to time. The price shown at checkout is the price that applies to the user's subscription.

The prices below are indicative monthly anchor prices for regional pricing bands. Local prices may be displayed in GBP or in a locally rounded equivalent currency, and taxes or payment charges may be added where required.

9.2 Market examples

The following examples show the recommended Plus price direction by market type. They are illustrative only and do not guarantee that a particular country will always remain in the same pricing band.

The final price may vary because of taxes, exchange movement, local payment behaviour, fraud risk, payment provider limitations, promotions, billing cycle, regional affordability assessments and local rounding. Gamecheck may change its prices or pricing bands prospectively. Any material price change for an existing recurring subscription will be communicated where required by law.

Users are responsible for reviewing the price, plan, renewal period and taxes shown at checkout before purchasing.

10. Payment processors

Card payments are processed by Stripe.

Crypto payments for annual subscriptions may be processed by NOWPayments.

Gamecheck does not store your full payment card details.

Payment data, transaction records and payment processing information may be handled and retained by the relevant payment provider in accordance with its own legal, regulatory, anti-money laundering, tax, accounting and compliance obligations.

Gamecheck may generate invoices and retain invoice, transaction and subscription records for legal, tax, accounting, audit, dispute and compliance purposes.

11. Refunds, cancellation and digital-service waiver

Gamecheck subscriptions are generally non-refundable, except where mandatory law requires otherwise.

Gamecheck does not provide partial refunds for unused subscription periods, unused checks, account closure, account suspension, permanent termination, service unavailability, delays, provider delays, casino blocking, unsuccessful checks, unresolved submissions or discontinued service, except where mandatory law requires otherwise.

You may cancel your account or subscription through the admin section when logged in.

Cancelling stops future access or renewal according to the cancellation flow, but it does not automatically entitle you to a refund for any unused period.

Because Gamecheck supplies digital services and digital content, Gamecheck will require a checkout acknowledgement before paid access begins. Gibraltar consumer distance-contract rules require express consent and acknowledgement before digital content not supplied on a tangible medium begins during the cancellation period if the trader wants the consumer's cancellation right to be lost.

At checkout, users must tick a box substantially in the following form:

Immediate access and cancellation acknowledgement

I expressly request and consent to Gamecheck beginning the supply of digital services and digital content immediately after purchase. I acknowledge that once Gamecheck begins supplying the service, including access to the extension, checks, analysis functionality or digital results, I may lose any statutory cancellation right that would otherwise apply during a cooling-off period, except where mandatory law provides otherwise.

Gamecheck will provide confirmation of this consent and acknowledgement in a durable medium, such as email or the user account area, where required by law.

Nothing in these Terms limits any refund, cancellation or consumer right that cannot lawfully be excluded.

12. How a Gamecheck submission works

A Gamecheck submission normally requires the player to:

  1. open the online casino game;
  2. use the Gamecheck Chrome extension;
  3. capture a screenshot of the game before making a spin;
  4. allow the extension to collect the game launch URL or related launch information;
  5. submit the information to Gamecheck for analysis; and
  6. receive a status message or further update where available.

Screenshots are user-initiated. A screenshot is captured only when the player uses the capture button in the extension.

A new screenshot is required for every new game. If you exit a game and later re-enter it, or if you open a different game, you must capture a new screenshot before using the extension again.

A screenshot submitted for one game must not be reused for another game.

13. Screenshot rules

The screenshot must clearly show the game title and the relevant game frame.

You are responsible for screenshot quality and accuracy.

Gamecheck may still attempt to process poor-quality screenshots, but poor-quality, incomplete, inaccurate, cropped, misleading or mismatched screenshots may prevent Gamecheck from verifying the game.

Gamecheck does not guarantee that it will request additional screenshots.

You must not submit:

  1. altered screenshots;
  2. AI-generated screenshots;
  3. screenshots from a different game;
  4. screenshots from a different provider;
  5. screenshots from a different casino session;
  6. screenshots captured after misleading or manipulating the game session;
  7. screenshots designed to deceive Gamecheck, a game provider, a casino or any third party; or
  8. screenshots that you do not have permission to submit.

Fraudulent screenshots, repeated false screenshots, manipulated submissions or intentionally misleading submissions may result in immediate suspension or permanent account termination.

14. What the screenshot captures

The Gamecheck screenshot tool is intended to capture only the casino game frame, not your entire screen, browser, desktop, other tabs, private messages, personal documents, financial information, chat windows or account balance.

You may adjust and resize the capture area to fit the game window.

You must not deliberately include personal information, third-party information, financial information, private communications or other sensitive content in a screenshot.

If personal information is accidentally included, Gamecheck may delete, restrict, redact or refuse to use the screenshot where appropriate.

15. Game launch URL collection and network monitoring

When you activate the extension for a game session, Gamecheck collects the game launch URL and related launch information by analysing network traffic for the site and session you have activated.

Monitoring is activated by the user for the relevant game session. It is not intended to monitor every website you visit.

Monitoring stops automatically once the required game launch URL or related information has been captured.

The extension is intended to collect information required to identify the game provider and authenticate the game, including:

  1. casino URL;
  2. game launch URL;
  3. root domain of the game launch URL;
  4. query string parameters in the launch URL;
  5. game name;
  6. provider name;
  7. timestamps;
  8. IP address;
  9. session ID;
  10. browser version; and
  11. authentication or whitelist matching status.

Gamecheck does not intentionally collect cookies, HTTP headers, POST bodies, response bodies, authentication credentials, account passwords, payment card details, bet amounts, win/loss amounts or personal casino account balances through this process.

16. Why the game launch URL is required

The game launch URL is required to identify whether the game session appears to belong to the actual game provider and whether it matches provider-confirmed data, provider whitelists or provider-authenticated information.

Gamecheck cannot provide the service properly without collecting the game launch URL or equivalent launch information.

The launch URL may be used to identify the game provider and authentication status. It is not used by Gamecheck to identify your bet amount, winnings, losses, casino balance or personal casino credentials.

17. If a casino blocks launch URL collection

If an online casino prevents Gamecheck from collecting the information required to verify a game, Gamecheck may return the following result:

Unable to Verify This Game

This online casino has prevented us from collecting the information required to verify this game.

As a result, we are currently unable to confirm whether this game has been authenticated by the game provider.

You may wish to try another game or check back later.

Where Gamecheck returns this message, Gamecheck will be treated as having fulfilled its service obligation for that submission.

No refund is available for an "Unable to Verify" result, except where mandatory law requires otherwise.

18. Gamecheck result statuses

Gamecheck may return one or more of the following statuses.

18.1 Real

This means the game appears to match provider-confirmed information, provider-approved whitelist data, or a provider response confirming that the game session is authentic.

18.2 Fake

This means Gamecheck has received clear evidence and confirmation from the relevant game provider, or has used provider-approved whitelist evidence, indicating that the game session is not genuine, is not authenticated, or does not correspond to the provider's authorised game environment.

18.3 Further Assessment Needed

This means Gamecheck needs more time, further provider input, deeper investigation, additional verification or confirmation before returning a final status.

18.4 Provider Is Not Contracted With Gamecheck

This means the relevant game provider is not currently contracted with Gamecheck or has not provided Gamecheck with the information required to authenticate the game.

18.5 Unable to Verify

This means Gamecheck could not verify the game because required information could not be collected, the casino blocked launch URL collection, the information submitted was incorrect or mismatched, the evidence was insufficient, or the provider did not confirm authenticity.

19. Response times

Gamecheck aims to provide results instantly where possible.

Some submissions may take up to 48 hours.

Deeper investigations may take up to 72 hours.

Investigations may take longer where Gamecheck is waiting for a provider response, provider confirmation, internal review or technical analysis.

A submission may remain unresolved.

Gamecheck does not guarantee a maximum response time in all cases.

20. Provider delays or failure to respond

Where a provider fails to respond, delays its response or requires more time, Gamecheck may inform the player that more time is needed because of provider review.

Gamecheck is not responsible for provider delay, provider non-response, provider error, provider withdrawal, provider correction or provider refusal to confirm evidence.

21. Incorrect submissions

If you submit incorrect information, mismatched screenshots, screenshots from the wrong provider, screenshots from a different game, screenshots from a different casino session or misleading information, the outcome of the analysis may be inaccurate or unavailable.

If Gamecheck determines that the screenshot does not match the game actually played, the provider claimed, the launch URL collected or the game information submitted, Gamecheck may be unable to verify the game and may provide no further notification of the outcome.

22. Appeals and repeated checks

Users do not have a formal appeal right.

Gamecheck does not guarantee a second review.

However, users may use the extension again for the same game, provided they capture a fresh screenshot and submit a new valid game session.

Gamecheck may refuse to treat repeated checks as appeals where the submissions appear abusive, automated, fraudulent or intended to manipulate the service.

23. Changes, corrections or withdrawals of results

Gamecheck may change, correct or withdraw a previous result if the relevant game provider confirms in writing that its original assessment was incorrect.

If a provider later determines that its assessment was incorrect, any dispute arising from the provider's incorrect assessment is a matter between the provider and the online casino, except to the extent mandatory law provides otherwise.

Gamecheck's role is limited to reporting provider findings, provider-approved whitelist data and evidence supplied or confirmed to Gamecheck at the time of assessment.

24. Conflicting provider information

Gamecheck does not identify or label a game as Fake unless it has received clear evidence and confirmation from the relevant game provider or provider-approved authentication data.

If providers give conflicting responses, Gamecheck may classify the submission as Further Assessment Needed, Unable to Verify, Provider Is Not Contracted With Gamecheck, or another appropriate status until the conflict is resolved.

25. Public findings and publication discretion

Gamecheck may publish findings about Fake games where Gamecheck has provider-confirmed evidence or provider-approved data.

Gamecheck may decide not to publish certain findings, including where the relevant provider is not contracted with Gamecheck, where evidence is incomplete, where legal review is required, where publication may mislead users, or where publication may prejudice an ongoing investigation.

Gamecheck may state publicly that multiple providers have been assessed and that Fake games have been found, provided that such statements are based on provider-confirmed evidence or provider-approved data.

26. Casino and provider challenges

Casinos may challenge findings by contacting disputes@gamecheck.com.

Providers may request correction of a result by confirming in writing, including by email where appropriate, that their assessment was incorrect or that a correction is required.

Gamecheck may request evidence, provider confirmation, technical records, domain information, launch URL information or other supporting material before changing a result.

27. No legal or evidential reliance

Gamecheck reports, status messages and findings are informational only.

You must not rely on Gamecheck reports as legal advice, regulatory advice, expert evidence, litigation evidence, financial advice, gambling advice or proof of a legal claim.

Gamecheck does not guarantee that a casino, regulator, court, provider, payment provider, law enforcement agency or other third party will accept a Gamecheck report.

If you intend to take legal action, submit a complaint to a regulator or make a claim against a casino, you should obtain independent legal advice and independent evidence.

28. No responsibility for casino, provider or third-party action

Gamecheck is not responsible for:

  1. casino decisions;
  2. casino account closures;
  3. casino refusal to pay winnings;
  4. casino bonus or account restrictions;
  5. provider responses;
  6. provider mistakes;
  7. provider delays;
  8. provider correction or withdrawal of information;
  9. regulator decisions;
  10. payment provider decisions;
  11. gambling losses;
  12. loss of winnings;
  13. blocked casino access;
  14. the accuracy of casino-provided information; or
  15. the accuracy of provider-provided information, except to the extent mandatory law states otherwise.

If a user loses money despite a game being reported Real, Gamecheck is not liable for that gambling loss.

29. Prohibited use

You must not:

  1. use Gamecheck if you are under 18;
  2. share your account;
  3. sell, rent, transfer or resell your account;
  4. use another person's account;
  5. use automated tools, bots, scripts or scraping;
  6. interfere with Gamecheck systems;
  7. hack, attack, reverse engineer or damage Gamecheck systems;
  8. damage Gamecheck's brand, reputation, service, security or infrastructure;
  9. submit false, altered, synthetic or AI-generated screenshots;
  10. submit screenshots from the wrong game or provider;
  11. attempt to manipulate a result;
  12. use Gamecheck to harass, defame, threaten or pressure any casino, provider or person;
  13. use Gamecheck reports misleadingly;
  14. imply Gamecheck endorses you, your casino, your website, your affiliate brand or your claim unless Gamecheck agrees in writing;
  15. bypass device or session limits;
  16. breach Chrome Web Store rules;
  17. breach applicable gambling laws; or
  18. use Gamecheck for unlawful purposes.

30. Suspension and termination

Gamecheck may suspend your account where repeated invalid or false screenshots are detected.

Gamecheck may also suspend your account where it detects account access from multiple devices located in different countries, activity inconsistent with normal individual use, suspected account sharing, suspected misuse of the extension or suspected fraud.

Gamecheck may permanently terminate your account if you try to hack Gamecheck systems, damage Gamecheck infrastructure, damage Gamecheck's brand or reputation, commit fraud, abuse the service, resell access, use automation, or seriously breach these Terms.

Gamecheck is not required to provide a warning before suspension or termination.

No refund is available where an account is suspended or terminated for breach of these Terms, except where mandatory law requires otherwise.

31. Service availability

Gamecheck does not guarantee uptime.

The service may be unavailable because of scheduled Gamecheck maintenance, Google Chrome or Chrome Web Store issues, AWS outages, Cloudflare outages, internet outages, provider outages, infrastructure provider outages, security incidents, emergency maintenance or other issues outside Gamecheck's control.

During these periods, some or all features of the extension may be temporarily unavailable until service is restored.

Where maintenance is planned, Gamecheck will try to provide notice. Emergency maintenance, third-party outages and security-related interruptions may occur without advance notice.

Gamecheck may delay investigations, temporarily suspend the service, restrict features, change service functionality or discontinue the service entirely.

If the service closes, active subscriptions will not be refunded except where mandatory law requires otherwise.

32. Chrome permissions

The Gamecheck Chrome extension requires permissions that allow it to capture the game screenshot and read or collect the game launch URL from browser network activity when the player activates the extension for a game session.

These permissions are necessary because Gamecheck requires the game launch URL and screenshot-derived game information to identify the game, identify the provider and authenticate the game with the relevant provider information.

The extension is not intended to read all page content, capture other browser tabs, collect private messages, collect casino balances, collect financial data or monitor unrelated websites.

The extension communicates with Gamecheck servers, including domains operated by or on behalf of gamecheck.com.

Gamecheck will keep its Chrome Web Store listing, privacy fields and in-extension disclosures consistent with this policy. Chrome requires privacy disclosures to be accurate and up to date, and Chrome's limited-use rules restrict collection and use of web browsing activity except where required for a user-facing feature disclosed in the extension listing and user interface.

Privacy and GDPR Notice

33. Controller

Gamecheck Limited is the controller of personal data processed through the Gamecheck service.

Gamecheck does not currently have a Data Protection Officer. Gamecheck will review whether a DPO must be appointed if its processing becomes large-scale, systematic or otherwise falls within Article 37 requirements.

Gamecheck does not currently have an EU GDPR representative. If Gamecheck is legally required to appoint one because of its offering of services to EU users or monitoring of EU user behaviour, Gamecheck will update this notice.

34. Personal data Gamecheck collects

Gamecheck may collect the following categories of personal data.

34.1 Account data

  1. username;
  2. email address;
  3. IP address;
  4. browser version;
  5. time zone;
  6. timestamps;
  7. session ID;
  8. account status;
  9. subscription status;
  10. security logs; and
  11. access logs.

34.2 Game session data

  1. casino URL;
  2. game name;
  3. provider name;
  4. game launch URL;
  5. full launch URL including query string parameters;
  6. root domain of the launch URL;
  7. timestamp of capture;
  8. screenshot of the casino game frame;
  9. authentication result;
  10. whitelist match status;
  11. provider response status;
  12. investigation notes; and
  13. internal evidence records.

34.3 Payment and billing data

  1. subscription plan;
  2. payment status;
  3. billing frequency;
  4. invoice records;
  5. transaction metadata;
  6. payment provider reference; and
  7. payment method type.

Gamecheck does not store full payment card details.

34.4 Technical, security and analytics data

  1. IP address;
  2. browser version;
  3. device/session security information;
  4. access logs;
  5. error logs;
  6. cookie identifiers;
  7. analytics identifiers;
  8. advertising and retargeting identifiers, where applicable; and
  9. service usage events.

34.5 Data Gamecheck does not intentionally collect

Gamecheck does not intentionally collect:

  1. phone numbers;
  2. full names during standard registration;
  3. device IDs;
  4. casino account passwords;
  5. casino cookies;
  6. HTTP headers;
  7. POST bodies;
  8. response bodies;
  9. bet information;
  10. win/loss information;
  11. personal messages;
  12. chat windows;
  13. account balances;
  14. financial information displayed inside casino accounts;
  15. personal data of third parties; or
  16. unrelated browser tab content.

35. Purposes of processing

Gamecheck processes personal data for the following purposes:

  1. creating and managing user accounts;
  2. verifying user login and account security;
  3. enforcing device and session limits;
  4. providing free trial checks;
  5. providing subscription access;
  6. processing payments and invoices;
  7. capturing user-initiated game screenshots;
  8. collecting game launch URLs;
  9. identifying game providers;
  10. matching launch URLs against provider whitelists;
  11. authenticating game sessions;
  12. sending evidence to providers where necessary;
  13. returning Gamecheck result statuses;
  14. conducting internal investigations;
  15. detecting fraudulent or invalid screenshots;
  16. detecting account sharing or misuse;
  17. responding to casino or provider disputes;
  18. correcting or withdrawing results;
  19. maintaining evidence files;
  20. preventing abuse, hacking and fraud;
  21. complying with legal, tax and accounting obligations;
  22. sending service messages;
  23. maintaining security and access logs;
  24. analysing website and extension usage;
  25. operating advertising, retargeting and analytics tools where permitted;
  26. improving service performance; and
  27. protecting Gamecheck's legal rights.

36. Lawful bases

Gamecheck relies on the following lawful bases, depending on the processing activity.

The Gibraltar GDPR requires processing to have a lawful basis, including consent, contract, legal obligation or legitimate interests where applicable.

36.1 Contract

Gamecheck processes account data, screenshots, launch URLs, provider information, result data, payment status and subscription information where necessary to provide the Gamecheck service you requested.

36.2 Legitimate interests

Gamecheck processes data for legitimate interests including fraud prevention, account security, misuse detection, provider verification, internal investigations, service improvement, dispute handling, evidence retention and protection of Gamecheck's legal rights.

36.3 Legal obligation

Gamecheck processes and retains certain data where required for tax, accounting, compliance, consumer law, data protection, legal claims or regulatory obligations.

36.4 Consent

Gamecheck may rely on consent for non-essential cookies, advertising cookies, retargeting, certain analytics activities, immediate supply of digital services where cancellation rights may be affected, and AI-assisted analysis where consent is legally required.

You may withdraw consent where consent is the lawful basis. Withdrawal of consent does not affect processing already carried out before withdrawal.

37. AI-assisted analysis and OpenAI

Gamecheck may use AI technology, including OpenAI technology, to assist with screenshot analysis, game identification, provider identification, workflow triage or internal investigation support.

OpenAI may act as a processor or sub-processor for Gamecheck where Gamecheck sends data to OpenAI services. OpenAI states that API data is not used to train or improve OpenAI models unless the customer explicitly opts in.

Gamecheck will not permit screenshots, launch URLs or user data submitted through the Gamecheck service to be used to train general AI models.

Gamecheck will enter into appropriate processor, sub-processor and data protection terms with any AI provider before sending personal data to that provider.

Where AI processing would involve an international transfer outside Gibraltar, the UK or the EEA, Gamecheck will ensure appropriate transfer safeguards are in place before the transfer, such as standard contractual clauses, transfer risk assessments, approved contractual safeguards, adequacy mechanisms or another lawful transfer mechanism.

If Gamecheck cannot ensure that AI processing complies with Gibraltar GDPR transfer, security and processor requirements, Gamecheck will not send personal data to that AI provider.

Human review may be used by the Gamecheck Investigation Team to confirm game/provider identification and ensure that the game launch URL is sent to or checked against the correct provider information.

38. Human review

Screenshots may be reviewed by the Gamecheck Investigation Team.

Human review is used only where needed to identify the game, identify the provider, verify the game launch URL, review evidence, resolve uncertainty, investigate fraud, handle disputes, correct results or protect the service.

Internal employees may access screenshot data where needed for their role.

Contractors do not receive screenshot data unless Gamecheck updates this notice and applies appropriate contractual, security and data protection safeguards.

39. Automated decision-making

Gamecheck may use automated matching against provider whitelists and launch URL data.

Gamecheck does not intend its status messages to produce legal effects concerning users or similarly significant effects. Gamecheck status messages are informational only.

Where automated processing materially affects your account, such as fraud detection or suspension, Gamecheck may review the matter internally.

40. Screenshot and provider sharing

Gamecheck does not routinely share screenshots with casinos.

Gamecheck may share screenshots, launch URLs, root domains, provider names, game names, timestamps, authentication status or other evidence with the relevant game provider where necessary to:

  1. identify the provider;
  2. verify whether the game belongs to that provider;
  3. confirm whether the game is Real or Fake;
  4. validate the game launch URL;
  5. resolve a dispute;
  6. investigate suspected counterfeit games; or
  7. correct or withdraw a result.

Where a screenshot is not necessary for provider verification, Gamecheck may share only the launch URL, root domain, game name, provider name, timestamp or other relevant technical information.

Gamecheck does not publish screenshots in public reports.

Gamecheck does not publish game launch URLs.

Gamecheck does not share screenshots with marketing partners, investors or advertisers.

41. Who receives personal data

Gamecheck may share personal data with the following categories of recipients.

41.1 Internal recipients

  1. Gamecheck Investigation Team;
  2. Gamecheck legal team;
  3. Gamecheck compliance personnel;
  4. Gamecheck senior management, for stored launch URLs and sensitive investigation data;
  5. technical and security personnel where required.

41.2 Service providers and processors

  1. AWS or other hosting/storage infrastructure providers;
  2. Cloudflare or other security, CDN or infrastructure providers;
  3. Stripe for card payment processing;
  4. NOWPayments for crypto payment processing;
  5. OpenAI or other AI processors used for screenshot or investigation support;
  6. analytics providers, including Google Analytics;
  7. advertising and retargeting providers, including Meta Pixel;
  8. Microsoft Clarity;
  9. email, logging, monitoring, customer support and security vendors; and
  10. professional advisers where necessary.

41.3 Game providers

Gamecheck may share launch URLs, root domains, provider names, game names, timestamps, screenshots or other evidence with the relevant game provider where necessary to authenticate the game, confirm provider ownership, verify whether a game is Real or Fake, correct a result or resolve a dispute.

41.4 Legal and regulatory recipients

Gamecheck may share data with courts, regulators, law enforcement, professional advisers or other third parties where required by law, necessary to defend legal claims, necessary to protect Gamecheck's rights, or necessary to prevent fraud, abuse or harm.

Gamecheck does not sell personal data.

42. International transfers

Gamecheck's primary screenshot storage location is stated as AWS Frankfurt, Eschborner Landstrasse 100, 60489 Frankfurt am Main, Germany.

Gamecheck intends to keep user data within Gibraltar, the UK and/or the EEA where possible.

Where personal data is transferred outside Gibraltar, the UK or the EEA, Gamecheck will use appropriate safeguards where required, such as standard contractual clauses, data processing agreements, transfer risk assessments, adequacy mechanisms or other lawful transfer mechanisms.

Gamecheck will not state publicly that data never leaves Gibraltar, the UK or the EEA unless that statement is technically and contractually accurate for every relevant provider, including AI, analytics, infrastructure, payment, support and security vendors.

43. Security

Gamecheck will implement appropriate technical and organisational measures designed to protect user data.

The Gibraltar GDPR requires security appropriate to risk, including, where appropriate, pseudonymisation and encryption, confidentiality, integrity, availability, resilience, restore capability and regular testing of security measures.

Gamecheck's security measures include or will include:

  1. encryption of screenshots at rest;
  2. encryption of screenshots in transit;
  3. encryption of launch URLs at rest;
  4. encryption of launch URLs in transit;
  5. encryption of evidence files at rest;
  6. TLS/HTTPS or equivalent secure transmission for personal data;
  7. strict role-based access controls;
  8. access logs;
  9. periodic access review;
  10. internal breach procedures;
  11. regular penetration testing;
  12. backup and restore procedures;
  13. production access restrictions;
  14. least-privilege access;
  15. internal security policies;
  16. audit trails for sensitive actions;
  17. secure key management; and
  18. regular testing and review of technical and organisational controls.

Gamecheck maintains ISO 27001 certification under Certificate Number IS 832990 for the information systems supporting the design, development, deployment and maintenance of the Gamecheck platform according to the statement of applicability V2.0.

No online service can guarantee absolute security.

44. Internal MFA

Gamecheck requires multi-factor authentication for internal access to systems that contain or provide access to:

  1. screenshots;
  2. launch URLs;
  3. evidence files;
  4. account data;
  5. subscription data;
  6. investigation systems;
  7. administrative systems;
  8. production cloud infrastructure;
  9. security logs;
  10. AI-processing dashboards;
  11. payment dashboards; and
  12. provider dispute records.

Gamecheck may suspend internal access where MFA is not enabled or where access controls are not satisfied.

45. Data Protection Impact Assessment

Gamecheck will maintain a Data Protection Impact Assessment covering the Gamecheck Chrome extension and related service.

The DPIA will assess:

  1. screenshot capture;
  2. game launch URL collection;
  3. browser network monitoring;
  4. provider sharing;
  5. AI-assisted analysis;
  6. automated whitelist matching;
  7. fraud detection;
  8. account-sharing detection;
  9. evidence retention;
  10. international transfers;
  11. security controls;
  12. encryption;
  13. MFA;
  14. user rights;
  15. data minimisation;
  16. retention periods; and
  17. risk to users.

The Gibraltar GDPR requires a DPIA where a type of processing, particularly using new technologies and taking into account the nature, scope, context and purposes of processing, is likely to result in a high risk to individuals. It also states what a DPIA must contain, including a description of processing, necessity and proportionality assessment, risk assessment and measures to address the risks.

Gamecheck will review the DPIA when there is a material change to the processing, technology, data categories, provider sharing, AI use, extension permissions, retention periods or risk profile.

Where a DPIA indicates that processing would result in a high risk in the absence of measures taken by Gamecheck to mitigate the risk, Gamecheck will consult the Gibraltar Information Commissioner where required.

46. Breach notification

Gamecheck maintains breach procedures.

Where a personal data breach occurs, Gamecheck will assess the incident and notify affected users and/or the Gibraltar Regulatory Authority where required by applicable law.

The Gibraltar GDPR requires notification to the Commissioner without undue delay and, where feasible, within 72 hours after becoming aware of a personal data breach, unless the breach is unlikely to result in a risk to individuals. It also requires communication to affected users without undue delay where the breach is likely to result in a high risk.

Gamecheck aims to notify affected users promptly where notification is required and where sufficient information is available.

47. Data retention

Gamecheck keeps personal data only for as long as necessary for the purposes described in this notice, unless a longer period is required for legal, tax, accounting, security, fraud prevention, dispute or compliance reasons.

47.1 Screenshots

Screenshots are retained for approximately 3 to 6 months after the assessment or investigation closes, unless a longer period is needed for fraud prevention, dispute handling, legal claims, provider correction or compliance.

47.2 Evidence files

Evidence files are retained for approximately 3 to 6 months, unless a longer period is needed for disputes, provider corrections, legal claims, fraud prevention or compliance.

47.3 Game launch URLs

Launch URLs may be retained indefinitely where anonymised, pseudonymised or retained in provider whitelist, authentication, evidence or anti-counterfeit databases.

Where launch URLs are linked to a specific user account, Gamecheck will remove, anonymise or pseudonymise the user link when it is no longer needed, subject to legal, security and dispute retention needs.

47.4 Account data

Account data is retained while your account is active and for a reasonable period after closure where needed for legal, fraud prevention, accounting, dispute, tax, security or compliance purposes.

47.5 Payment records

Payment providers and Gamecheck may retain payment, invoice and transaction records for legal, tax, accounting, anti-money laundering, audit and compliance purposes.

47.6 Backups

Deleted screenshots and other deleted data will be removed from backups according to Gamecheck's backup deletion cycle, unless retention is required for security, legal or compliance reasons.

48. Your privacy rights

Subject to applicable law, you may have the right to:

  1. access your personal data;
  2. receive a copy of your personal data;
  3. correct inaccurate personal data;
  4. request deletion of personal data;
  5. restrict processing;
  6. object to processing based on legitimate interests;
  7. object to direct marketing;
  8. request data portability;
  9. withdraw consent where processing is based on consent;
  10. request information about automated decision-making;
  11. complain to the Gibraltar Regulatory Authority; and
  12. complain to another relevant supervisory authority where applicable.

Gamecheck may verify your identity using your email address and username.

Gamecheck aims to respond to privacy requests within one week, where reasonably possible.

Requests are generally free, but Gamecheck may refuse or charge a reasonable fee for manifestly unfounded, excessive or repetitive requests where permitted by law.

Some deletion requests may not be fulfilled immediately where data must be retained for legal, security, fraud prevention, accounting, dispute or provider investigation purposes.

49. Account closure and deletion

You may close your account through the admin section when logged in.

Closing your account does not automatically delete all records immediately.

Gamecheck may retain data where required or permitted for subscription records, payment records, tax, accounting, fraud prevention, legal claims, provider disputes, evidence retention, security logs or compliance.

Unused subscription periods are not refunded when you close your account, except where mandatory law requires otherwise.

50. Cookies, analytics and advertising

Gamecheck's website may use cookies and similar technologies.

Gamecheck may use:

  1. essential cookies;
  2. analytics cookies;
  3. advertising cookies;
  4. retargeting cookies;
  5. Google Analytics;
  6. Meta Pixel; and
  7. Microsoft Clarity.

Gamecheck does not currently use Hotjar.

Non-essential cookies should be used only where permitted by law, including with consent where required.

Gamecheck will provide a cookie banner or similar consent mechanism where required by Gibraltar cookie and privacy rules.

You may manage cookies through the cookie banner, browser settings or account settings where available.

Deleting your account may stop account-based processing but does not automatically remove cookies already stored in your browser. You can remove those through your browser settings.

51. Marketing

Gamecheck may send service messages relating to your account, subscription, security, checks, results, outages or legal notices.

Gamecheck may send marketing messages where permitted by law.

You may opt out of marketing communications using unsubscribe links or by contacting Gamecheck.

You cannot opt out of essential service, legal, security or account messages.

52. Data protection complaints

If you have a privacy concern, contact compliance@gamecheck.com first so Gamecheck can investigate.

You may also complain to the Gibraltar Regulatory Authority or another competent supervisory authority where applicable.

Intellectual Property and Submitted Materials

53. Gamecheck intellectual property

Gamecheck owns or licenses the Gamecheck extension, website, software, interface, databases, whitelists, status logic, reports, trademarks, logos, service design, documentation and related intellectual property.

You must not copy, modify, reverse engineer, decompile, distribute, resell, scrape, mirror, frame, extract, commercialise or create derivative works from Gamecheck without written permission.

You do not acquire any ownership rights in Gamecheck software, data, reports, systems, whitelists or trademarks by using the service.

54. Submitted screenshots and evidence files

As between you and Gamecheck, you agree that Gamecheck may own, control and retain submitted screenshots, evidence files and investigation records created through your use of the service, subject to applicable law and third-party intellectual property rights.

You acknowledge that screenshots may include third-party game artwork, casino content or provider content. Gamecheck does not claim ownership of third-party game intellectual property.

To the extent any rights in a submitted screenshot or evidence file belong to you and cannot lawfully be assigned to Gamecheck, you grant Gamecheck a worldwide, royalty-free, irrevocable licence to use, store, copy, analyse, retain, disclose and process that screenshot or evidence file solely for service delivery, provider verification, investigation, fraud prevention, security, dispute handling, legal compliance and recordkeeping.

Gamecheck will not publish screenshots in public reports.

Screenshots may be used in internal investigation files and evidence files.

Screenshots may be shared with the relevant game provider where necessary to verify the game, confirm the provider, validate the launch URL, resolve a dispute, investigate suspected counterfeit games or correct a result.

55. User sharing of Gamecheck reports

Users may share Gamecheck results for personal informational purposes.

However, you must not alter, misrepresent, selectively edit or remove context from a Gamecheck report.

You must not claim that Gamecheck endorses you, your website, your business, your legal claim, your casino complaint, your affiliate activity or your public statements unless Gamecheck has agreed in writing.

You share Gamecheck reports at your own risk.

Legal Terms

56. Warranties and disclaimers

Gamecheck provides the service on an "as is" and "as available" basis.

Gamecheck does not warrant that:

  1. every game can be verified;
  2. every provider will respond;
  3. every provider will be contracted with Gamecheck;
  4. every casino will permit launch URL collection;
  5. every result will be instant;
  6. every result will be final;
  7. every provider response will be accurate;
  8. the service will be uninterrupted;
  9. the service will be error-free;
  10. the extension will work on every casino website;
  11. a game reported Real will remain Real indefinitely;
  12. a casino will accept a Gamecheck result;
  13. a regulator will accept a Gamecheck result;
  14. a court will accept a Gamecheck result; or
  15. a user will recover gambling losses.

Gamecheck does not guarantee that the result of any submission will prevent losses, recover losses, prove fraud, establish liability or resolve a dispute with a casino.

57. Liability cap

To the fullest extent permitted by law, Gamecheck's total aggregate liability to you arising out of or in connection with the service, the extension, any subscription, any submission, any result, any delay, any inability to verify, any provider response or these Terms shall not exceed EUR 1,000,000.

This liability cap applies whether the claim arises in contract, tort, negligence, misrepresentation, breach of statutory duty, restitution or otherwise.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability that cannot be excluded under applicable consumer law.

58. Indemnity

You agree to indemnify Gamecheck against losses, claims, damages, costs and expenses arising from:

  1. your breach of these Terms;
  2. your fraudulent submission;
  3. your altered or AI-generated screenshot;
  4. your misuse of a Gamecheck report;
  5. your unlawful use of the extension;
  6. your account sharing or resale;
  7. your attempt to manipulate a result;
  8. your breach of third-party rights;
  9. your breach of casino terms; or
  10. your use of Gamecheck in legal, public, commercial or promotional claims contrary to these Terms.

This indemnity does not apply to the extent prohibited by consumer law.

59. Professional indemnity insurance

Gamecheck maintains professional indemnity insurance.

The existence of insurance does not increase Gamecheck's liability beyond the limits set out in these Terms and does not create any direct right of claim against Gamecheck's insurer.

60. Complaints procedure

Before starting litigation, you must first submit your complaint to Gamecheck using the relevant contact address:

Your complaint should include your username, email address, submission reference, date, game name, provider name, casino URL, relevant screenshots or evidence, and a clear description of the issue.

Gamecheck will review complaints internally and may request further information.

Nothing in this section prevents you from exercising rights that cannot legally be restricted.

61. Arbitration

These Terms do not require arbitration unless Gamecheck and you separately agree to arbitration in writing or arbitration is required by mandatory law.

62. Governing law and courts

These Terms are governed by the laws of Gibraltar.

Subject to any mandatory consumer rights that allow you to bring claims elsewhere, the courts of Gibraltar shall have jurisdiction over disputes arising from or relating to these Terms, the Gamecheck service, the extension, subscriptions, submissions, reports or results.

63. Changes to these Terms

Gamecheck may update these Terms from time to time.

Where changes are material, Gamecheck will provide reasonable notice where practicable.

Continued use of the service after changes take effect means you accept the updated Terms.

If you do not accept the updated Terms, you must stop using Gamecheck and cancel your account.

64. Changes to the service

Gamecheck may change, suspend, withdraw, limit, discontinue or replace any part of the service at any time.

This includes changes to the extension, subscriptions, free trial, result statuses, provider coverage, response times, investigation workflow, data collection methods, AI tools, payment providers, reports and public findings.

65. Assignment

You may not assign or transfer your account, subscription, rights or obligations under these Terms without Gamecheck's written consent.

Gamecheck may assign, transfer or subcontract its rights and obligations in connection with a merger, acquisition, restructuring, financing, sale of assets, corporate reorganisation or service provider arrangement.

66. Severability

If any part of these Terms is found invalid, unlawful or unenforceable, the remaining parts remain in effect.

67. Entire agreement

These Terms, together with any checkout terms, privacy disclosures, cookie notices and in-extension notices, form the agreement between you and Gamecheck regarding your use of the service.
